Litigation Program

Al Otro Lado is the organizational plaintiff in Al Otro Lado v. Kelly, a class-action lawsuit challenging CBP’s unlawful practice of denying asylum seekers access to the U.S. asylum system. Al Otro Lado is represented by the Center for Constitutional Rights, the American Immigration Council, and Latham & Watkins.

Al Otro Lado is co-counsel in the class-action lawsuit, Gonzalez v. Core Civic, which alleges that the private prison subcontractor routinely violates labor trafficking law by forcing detained immigrants to work inside its detention centers at little to no compensation. Al Otro Lado’s partners in this litigation are the law firm of Burns Charest and Adhoot Wolfson and the nationally acclaimed Law Office of Andrew Free.

Al Otro Lado has filed dozens of civil rights / civil liberties complaints in individual cases before the Office of Inspector General, and in collaboration with advocacy partners.

On August 20, 2018, the court denied in part and granted in part the government’s motion to dismiss, allowing the majority of plaintiffs’ claims to go forward.
